Programme:

Day 1: Disciplinary Hearings - Misconduct Offences

  • Initiating Suspension, Hearings prior to automatically suspending employees pending misconduct hearings
  • Issuing warnings to employees
  • The investigation of misconduct transgressions
  • The design and drafting of the charge sheet, notice to attend and representation
  • Addressing specific previously difficult matter drugs intercepted email alcohol and post-traumatic stress
  • The law of evidence - polygraph results, video evidence, and third party interventions
  • The enquiry process and the new CCMA guidelines
  •  Appeal Hearings - do we need them? 

Day 2: Conducting misconduct arbitrations at the CCM

  • Arbitration bound by labour court decisions (precedents)
  • Rules for commissioners when dealing with misconduct arbitrations
  • Locus standi rules now enforced
  • The award must be lawful, must be procedurally fair and reasonable
  • CCMA, arbitration are held " de vovo " new evidence, not a repeat of the previous hearing
  • Preliminary issues ( in liminie) raised at arbitration now require immediate ruling by the commissioner
  • The CCMA guidelines of the six stages of arbitration
  • Commissioner required to take notes of the testimony provided by participants
  • Substantive and procedural fairness application
