Day 1: Disciplinary Hearings - Misconduct Offences

Initiating Suspension, Hearings prior to automatically suspending employees pending misconduct hearings

The design and drafting of the charge sheet, notice to attend and representation

Addressing specific previously difficult matter drugs intercepted email alcohol and post-traumatic stress

The enquiry process and the new CCMA guidelines

Appeal Hearings - do we need them?
Day 2: Conducting misconduct arbitrations at the CCM

Arbitration bound by labour court decisions (precedents)

Rules for commissioners when dealing with misconduct arbitrations

Locus standi rules now enforced

The award must be lawful, must be procedurally fair and reasonable

CCMA, arbitration are held " de vovo " new evidence, not a repeat of the previous hearing

Preliminary issues ( in liminie) raised at arbitration now require immediate ruling by the commissioner

The CCMA guidelines of the six stages of arbitration

Commissioner required to take notes of the testimony provided by participants

Substantive and procedural fairness application
